1. Overview

The website coolha.com (the "Site") provides you with information, tools and services for interacting with the Lens Protocol, a composable decentralized social graph protocol.

By accessing this Site, you agree to be bound by the following terms and conditions (the "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink (collectively, the "Agreement"). This Agreement applies to all users of the Site, including without limitation browser users, builders and/or content contributors.

Please read these Terms carefully before accessing or using this Site. If you do not agree to all the terms of this Agreement, you should not access the Site; however, by accessing the Site, you agree to this Agreement.

Any new features or tools added to the Site shall also be subject to the Terms. You can review the most current version of the Terms at any time on this page. We reserve the right to update, change or replace any part of these Terms by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

2. General conditions

You may not use our site for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). We reserve the right to refuse service to anyone for any reason at any time. We may stop (permanently or temporarily) providing the Services or any features within the Site to you or users generally.

3. Service

User Lens Profiles are referred to as "Profiles" on the Site.

This website allows you to interact with Lens Protocol, including posting, mirroring, commenting, and other content-related actions.

We reserve the right, but have no obligation, to limit the provision of Personal Data or Services to any person, geographic region or jurisdiction. We may exercise this right at our discretion on a case-by-case basis.

**Your Personal Data, Your Responsibilities. **

  • You are responsible for protecting the wallet containing your personal data.
  • It is your sole responsibility to evaluate the Site and its features before using them.
  • You are responsible for the content posted in your profile.

It is important to understand that neither we nor any affiliated entity is a party to any transaction on the Lens Protocol underlying blockchain network; we have no ownership, custody, or control of any items in your wallet, nor do we have ownership, custody, deletion, or control Any items on any user's wallet or interaction with the Lens Protocol.

If you are not comfortable interacting with an inherently transparent blockchain, you should not cooperate with our website to create and manage User Content on the Lens Protocol. You are solely responsible for maintaining the private keys associated with the blockchain addresses used to interact with the Lens Protocol. Transactions on the blockchain, including transfers of tokens and additional data, are permanent and cannot be undone.

Our website allows you to upload images, videos, hosted on third party providers IPFS and Arweave. We are not responsible for any actions or inactions by IPFS/Arweave, whether in the user interface or otherwise. Your use of and access to any third-party products or services, including through the Site, is at your own risk.

Lens Protocol is deployed on a blockchain-based network and we are not responsible for the operation of such networks.

4. User Content

You are solely responsible for any content you provide by interacting with Lens Protocol ("User Content"). You should only provide User Content to Lens Protocol that you are willing to share with others. You represent and warrant that you own or have obtained all necessary rights, licenses, consents, permissions, powers and/or authorizations to grant the rights granted hereunder in any User Content you post.

We are not responsible for User Content on Lens Protocol, but we reserve the right not to display on our website any User Content originating from Lens Protocol that violates these Terms, including without limitation infringing any third party copyright or trademark or otherwise Intellectual Property Misappropriation of User Content. Impersonate, act illegally, or constitute harassment.

Use of, reliance on or collection of any User Content or materials displayed on or obtained through the Services is entirely at your own risk. We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy or reliability of any User Content or communications posted through the Services, nor do we endorse any opinions expressed through the Services. You understand that when using the Services, you may be exposed to User Content that may be offensive, harmful, inaccurate, or otherwise inappropriate, or, in some cases, posts that may be mislabeled or deceptive . All User Content is the sole responsibility of the originator of such User Content. We may not monitor or control User Content posted through the Services, and we are not responsible for such User Content.

User Content may contain, contain or otherwise be associated with certain characters, artwork or other original works ("Works") provided by Profiles (which may represent artists, musicians and other creators) in an irreplaceable Coins ("Tokens" or "Tokens") are provided for collection.

All transactions related to the Services, including the provision of tokens for collection, are conducted and recorded solely through the Profile's interaction with blockchain-based networks that are not controlled by or affiliated with the Services. The Service does not hold, nor can it buy, sell or trade any Tokens, nor can the Service set, change or enforce any collection conditions set by Personal Data.

While the tokens are owned by you when you collect them, the artwork contained within them is licensed and will not be transferred or sold to you. Ownership means that the ownership of the Token is recoded on the blockchain-based network. Subject to the fact that you lawfully obtained the token and continue to possess the token, the user controlling the profile grants you a worldwide, non-exclusive, revocable, royalty-free license, without the right to sublicense you as-is to display such order. The artwork contained in the token, unless a broader license is granted to you under the token metadata. For the avoidance of doubt, to obtain the foregoing permission, you must independently verify that the user controlling the Profile has the authority to collect the Tokens (including, without limitation, copyright).

All Tokens are provided by The Profiles as is, without warranties or representations of any kind, either express or implied. Tokens may contain errors and it is the acquiring user's responsibility to independently verify their accuracy, completeness and suitability before collecting Tokens.

We do not provide a warranty. We make no representations about the quantity, adequacy or quality of the services it provides to you. We make no guarantee that it will display your User Content or artwork for collection, and the Service is provided on an "as is" and "as available" basis. We make no warranties, and disclaim to the fullest extent permitted by law, all implied warranties, statutory or other, including warranties of merchantability, fitness for a particular purpose, compliance with law, non-infringement, title or based on course of dealing or usage of trade any guarantee.

5. Intellectual Property and Ownership

Content creators and owners retain their existing rights to any content uploaded, edited or created through the Services. However, by using the Services, all users (including content creators and owners) grant to each other a limited license to use their Contributions in various ways, as described below.

By submitting, posting or displaying Content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, Publish, transmit, display and distribute such content in any and all media or distribution methods now known or hereafter developed (for clarity, these rights include, for example, curation, transformation and translation). This License authorizes us to make your User Content available to the rest of the world, and for others to do the same.

By posting content on our website, you represent and warrant that you have obtained all necessary intellectual property rights in such content, including without limitation any trademark, copyright, patent, trade secret or proprietary right (including without limitation any music or rights to perform, master and/or publish video content). You further represent and warrant that the posting and use of your Content on our Platform will not infringe or violate any third party rights, including without limitation any intellectual property rights, privacy rights, or publicity rights. We assume no responsibility or liability for any unauthorized use of any User Content made available through the Site.

Digital Copyright Act (DMCA) Notice and Takedown Procedure We respect the intellectual property rights of others. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible through our Site, please notify our designated Copyright Agent as set forth below.

We reserve the right to terminate access to our Site by users who repeatedly infringe the copyright rights of others.

We are not responsible for any errors or inaccuracies in content published on this website. Profiles are solely responsible for their actions on the website.

As a website, we provide information about user content posted on the Lens Protocol and interactions with that content.

We reserve the right at any time to modify or discontinue this Site (or any part or content thereof) without notice. We will not be liable for any modification, change of information, suspension or discontinuance of this website.

8. Third Party Services and Websites

We are not responsible for the content or services of any third party, including without limitation any web applications such as MetaMask, and we make no representations regarding the content or accuracy of any third party services or materials. These are subject to the third party provider's terms of use.

Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party merchandise should be directed to the third-party.
